Terms and Conditions of allrounder mountain resort gmbh & co. kg
A. General Provisions
I.
Offers and services are provided based on these General Terms and Conditions unless otherwise agreed individually in writing. The customer’s terms and conditions shall only apply if expressly agreed in writing in advance.
II.
allrounder mountain resort gmbh & co. kg shall be liable for its contractual obligations with the diligence of a prudent businessman. Claims for damages by the customer are excluded. This exclusion does not apply to damages resulting from injury to life, body, or health if allrounder mountain resort gmbh & co. kg is responsible for the breach of duty, nor to other damages resulting from intentional or grossly negligent breaches of duty by allrounder mountain resort gmbh & co. kg, or from intentional or negligent breaches of essential contractual obligations. A breach of duty by a legal representative or vicarious agent shall be deemed equivalent to a breach by allrounder mountain resort gmbh & co. kg.
III.
In the event of slight negligence, liability for damages and contractual disruptions of any kind, except in cases involving injury to life, body, or health, shall be limited to €250,000 for property damage. All claims against allrounder mountain resort gmbh & co. kg shall generally become time-barred one year after the statutory commencement of the limitation period. Claims for damages shall become time-barred after five years regardless of knowledge. These reductions in limitation periods shall not apply to claims based on intentional or grossly negligent breaches of duty, claims based on intentional or negligent breaches of essential contractual obligations, or claims involving injury to life, body, or health.
IV.
The customer may only offset, reduce, or exercise a right of retention against claims of allrounder mountain resort gmbh & co. kg if the counterclaim is undisputed or legally established.
V.
allrounder mountain resort gmbh & co. kg reserves the right to verify the coverage of provided credit card guarantees.
VI.
Pets may only be brought along with prior consent from allrounder mountain resort gmbh & co. kg and may be subject to an additional charge.
VII.
Items left behind by the customer will be forwarded upon request, at the customer’s risk and expense. allrounder mountain resort gmbh & co. kg will store such items for three months, after which they will be handed over to the local lost and found office if they have recognizable value; otherwise, allrounder mountain resort gmbh & co. kg may destroy the items after expiration of the storage period.
VIII. Vouchers
Vouchers are generally excluded from exchange.
Vouchers are transferable.
Vouchers cannot be redeemed for cash.
No interest shall accrue on voucher balances.
Vouchers for courses, gastronomic services, and other packages may only be redeemed subject to prior booking and availability.
Validity periods specified by allrounder for service and value vouchers are binding.
Purchased vouchers are valid for 3 years. The validity period begins at the end of the year in which the voucher was purchased.
The voucher must be presented on-site and in its original form upon redemption. Copies cannot be accepted.
Stolen or lost vouchers cannot be replaced.
IX. Flockenkarte
The participation conditions applicable to the Flockenkarte program must be accepted upon first registration together with the General Terms and Conditions and Privacy Policy.
X.
Amendments or additions to contractual agreements or these General Terms and Conditions must be made in writing. In addition, the terms agreed upon at the time of contract conclusion shall apply.
XI.
The place of performance, payment, and exclusive jurisdiction for commercial transactions shall be the registered office of allrounder mountain resort gmbh & co. kg. If a contracting party fulfills the requirements of Section 38 (2) German Code of Civil Procedure and has no general place of jurisdiction within Germany, the registered office of allrounder mountain resort gmbh & co. kg shall apply as the place of jurisdiction.
XII.
German law shall apply. The application of the UN Convention on Contracts for the International Sale of Goods (CISG) and conflict-of-law rules is excluded.
XIII.
Should individual provisions of these General Terms and Conditions be or become invalid or void, the validity of the remaining provisions shall remain unaffected. Otherwise, statutory provisions shall apply.
B. Ski Hall, Lift Facilities
I.
For contracts concerning the use of the ski hall, these General Terms and Conditions (Section B) apply in addition to Section A.
II.
Access to the snow-covered area is only permitted with skis, snowboards, or similar sliding equipment (sleds are not permitted). Use of the lift facilities is governed by the posted transport conditions. Waiting times outside the ski slope due to technical or visitor-related reasons are possible and do not entitle the customer to cancel the booked service or demand a refund, since the booked service can still be made up.
The admission ticket is non-transferable. It remains the property of allrounder mountain resort gmbh & co. kg as a reusable data carrier. In the event of misuse, allrounder mountain resort gmbh & co. kg has the right to confiscate the ticket without compensation.
III.
If the ticket and receipt are lost in the slope area, the maximum possible use of the slope on that day up to the time the loss is reported will be charged unless the customer proves that actual use was significantly shorter. If only the ticket is lost, settlement shall be made upon presentation of the receipt at the payment desk. Access authorizations of any kind are non-transferable.
IV.
The deposit paid for the lift ticket will be refunded within 3 years after the last use upon presentation of the intact lift ticket.
V.
allrounder mountain resort gmbh & co. kg reserves the right to restrict the use of season tickets in individual cases due to special events. In such cases, the customer will be informed at least 2 weeks in advance by notice.
C. Snow Sports School
I.
For contracts concerning participation in snow sports school courses, these General Terms and Conditions (Section C) apply in addition to Section A.
II.
allrounder mountain resort gmbh & co. kg may withdraw from the contract and cancel the course if the minimum number of 4 participants for group courses is not reached or if the course cannot be carried out for reasons within its sphere of responsibility (e.g. technical defect, illness of the instructor). In such cases, participants will be informed immediately and course fees refunded without delay.
III.
Ski school instruction is provided exclusively by the ski and snowboard school “SnowWorld Neuss.” It has the exclusive right to organize events and ski and snowboard courses at SnowWorld Neuss. Third parties are prohibited from offering corresponding services in the name of the allrounder group or SnowWorld Neuss.
Exceptions may be granted for registered non-profit associations. Written approval from the allrounder group is required. There is no entitlement to approval.
Applications may be submitted by email or post and must include:
Full names of the board members
Proof of umbrella association membership
Current statutes
Dates of the visit
Full names of instructors
Qualification certificates of instructors
Number of participants
Number of instructors
D. Rental Equipment
For contracts concerning the paid rental of equipment from allrounder mountain resort gmbh & co. kg to the customer, these General Terms and Conditions (Section D) apply in addition to Section A.
Rental equipment must be returned immediately after leaving the slope or climbing park. Any attempt to remove rental equipment from the building will result in criminal charges being filed.
In the event of damage, allrounder mountain resort gmbh & co. kg is entitled to demand 50% of the new value of the rental equipment as lump-sum compensation. The company reserves the right to prove higher damages. The customer remains entitled to prove that no damage occurred or that the damage was significantly lower.
E. Abenteuer Alm
For contracts concerning the use of Abenteuer Alm, these General Terms and Conditions (Section E) apply in addition to Section A. The usage instructions posted at the entrance apply.
E1. General Use
Use of the facilities is at the user’s own risk.
Parents and supervisors are obliged to fulfill their legal duty of supervision.
Children may only use the facilities under age-appropriate supervision.
E2. Age and Usage Requirements
Use is only permitted within the specified age and height requirements of the respective play equipment.
Equipment may only be used by the intended number of persons at the same time.
Equipment may only be used for its intended purpose.
E3. Conduct on the Premises
Consideration for other visitors is mandatory.
Pushing, shoving, jostling, and risky behavior are prohibited.
Climbing, hanging, or jumping outside designated areas is prohibited.
Instructions from staff must be followed at all times.
E4. Jumping Cushions / Trampolines
Shoes, sharp objects, and loose items must be removed before use.
Somersaults or risky jumps are prohibited.
Use is prohibited when there are large differences in age or weight between users jumping simultaneously.
E5. Slides
Slides may only be used sitting down, feet first.
Standing or climbing on the slide surface is prohibited.
The landing area must be vacated immediately.
E6. Climbing Facilities
Use only within designated safety areas.
Do not climb outside designated grips or nets.
Swinging or hanging from structural elements not intended for this purpose is prohibited.
E7. Water Play Areas
Beware of slipping hazards.
Suitable footwear is recommended.
Use is prohibited during thunderstorms or extreme weather conditions.
E8. Clothing and Objects
Loose items such as mobile phones, keys, jewelry, or glasses may not be carried if there is a risk of injury.
Scarves, cords, and loose clothing are prohibited for safety reasons.
E9. Health Restrictions
Use is not suitable for persons with:
Cardiovascular diseases
Severe back or spinal problems
Epilepsy
Balance disorders
Other health impairments aggravated by physical strain
In cases of doubt, use should be avoided.
